Terms of Service

These Terms of Service ("Terms") govern your use of CuePoint, an iMessage app operated by Riley McLeaming ("CuePoint," "we," "us"). By downloading or using CuePoint, you agree to these Terms.
1. What CuePoint does
CuePoint lets you pick a moment from a song and send it to a friend in iMessage. Anyone can send and receive free 30-second previews. Sending a clip from a full-length track requires the sender to have an active Apple Music subscription, authenticated on their own device via Apple's MusicKit.
2. Not affiliated with Apple
CuePoint is an independent app and is not affiliated with, endorsed by, or sponsored by Apple Inc. "Apple Music," "iMessage," and related marks belong to Apple Inc. Song preview audio is streamed from Apple's iTunes Search API; full-song playback uses Apple's MusicKit framework and an Apple Music subscription. Your use of Apple Music is governed by Apple's own terms, separately from these Terms.
3. Eligibility
You must be able to form a binding contract to use CuePoint, and you must comply with the age requirements of your Apple ID and the App Store. If you're using CuePoint on behalf of a minor's Apple ID, you're responsible for their compliance with these Terms.
4. Acceptable use
You agree not to use CuePoint to:
- Infringe or misappropriate anyone else's copyright, trademark, or other intellectual property rights, including by using CuePoint to distribute music in a manner not authorized by the rights holder or by Apple's licensing terms;
- Circumvent, disable, or otherwise interfere with clip-length limits, security features, or content protections built into the app or into Apple's services;
- Send content that is unlawful, harassing, or that violates the rights of others;
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except where applicable law permits it;
- Use the app in any way that violates Apple's App Store Review Guidelines or Media Services Terms.
We may suspend or terminate access for anyone who violates this policy, and — consistent with our copyright policy below — we will terminate the access of users determined to be repeat infringers.
5. Content and intellectual property
CuePoint does not host, own, or store the songs you clip. Audio is streamed directly from Apple at the time of playback. All rights in the underlying music remain with the applicable rights holders (labels, publishers, artists). A clip sent through CuePoint is a link/reference resolved through Apple's services, not a file CuePoint distributes or retains a copy of. Using CuePoint does not grant you any ownership rights in the music.
6. Copyright policy (DMCA)
CuePoint respects the intellectual property rights of others and expects users to do the same.
Filing a notice. If you believe content accessible through CuePoint infringes your copyright, you may send a notice to our designated agent that includes, per 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the material claimed to be infringing, and information reasonably sufficient to locate it;
- Your contact information (address, phone number, and email);
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-notice. If you believe content was removed or disabled by mistake or misidentification, you may submit a counter-notice with: your signature, identification of the material and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed in error, and your consent to the jurisdiction of the federal court in your district (or, if outside the U.S., any district in which we may be found).
Repeat infringers. We will terminate, in appropriate circumstances, the access of users who are repeat infringers.
7. Apple Music affiliate disclosure
Links inviting you to subscribe to Apple Music may be affiliate links. If you subscribe through one, CuePoint may earn a commission at no extra cost to you.
8. Disclaimers
CuePoint is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee that the app will be uninterrupted, error-free, or that any particular song will be available for preview or full playback — availability depends on Apple's catalog and services, which are outside our control.
9. Limitation of liability
To the fullest extent permitted by law, CuePoint and Riley McLeaming will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, even if advised of the possibility of such damages.
10. Termination
You may stop using CuePoint at any time by deleting the app. We may suspend or terminate your access if you violate these Terms.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the effective date above. Continuing to use CuePoint after changes take effect means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.
